We want to make sure you are aware of a new federal policy that could affect immigrant families who rely on public benefits like Medicaid.
The Department of Homeland Security has finalized a new “public charge” rule, set to take effect on September 18, 2026. This rule gives immigration officers broad authority to consider whether a prospective citizen is likely to rely on government assistance, including Medicaid, when deciding on green card applications.
Why this is concerning:
Disability advocates are deeply concerned that this rule will have a “chilling effect” on families. The fear is that immigrant parents may disenroll their children from vital programs like Medicaid or special education services out of fear that using these benefits will harm their immigration status, even if the children are U.S. citizens.
Medicaid is often the primary way individuals with autism and developmental disabilities access crucial healthcare, therapies, and home-based supports. Forcing families to choose between their child’s necessary care and their family’s immigration status is an incredibly difficult burden.
